Article 1 : Definitions
“Platform”: the Stopingo service, available on the web, on iOS and Android and over WhatsApp. “Member”: any registered person, whether they travel as a “Passenger” or drive as a “Driver”. “Journey”: a Passenger's trip, made of one or more car “Legs”, linked where needed by walking. “Boarding code”: the code displayed by the Driver and typed in by the Passenger when getting in. “Cost share”: the portion of a Leg's actual costs due to the Driver. “Service price”: the amount charged to the Passenger by Stopingo.
Article 2 : Purpose
Stopingo operates a matching platform for sharing journeys between private individuals. The service rests on cost sharing: a non-professional Driver never makes a profit; the amount proposed is capped automatically under the legal rule (fuel, tolls, wear), pro rata to the number of passengers.
Article 3 : Acceptance and versions of these terms
Using the service constitutes acceptance of these terms and of the privacy policy. The terms are versioned: when their content changes, the new version is presented to you and your acceptance is recorded. You always know which version you accepted, and when.
Article 4 : Account, eligibility and personal nature
Creating an account requires accurate information and identity verification. That is what lets everyone know who they are travelling with. All use of the service is personal: an account is not lent, sold or shared, and every Member must match the identity provided. Stopingo may require a fresh identity check where there is serious doubt about compliance with these terms or to prevent fraud; failing that, access to certain features may be restricted (Article 13). Some features are reserved for adults.
Article 5 : Availability of the service
The service is under development and access is by invitation. Its features may change, be added or removed; changes that alter your rights or obligations give rise to a new version of these terms (Article 3). Access to the Platform and registration are free; only completing a Journey gives rise to the payment described in Articles 7 and 10.
Article 6 : The platform's role
Stopingo acts as a technical intermediary matching private individuals. Stopingo is neither a carrier, nor an employer of Drivers, nor a party to the Journey: the Journey is carried out under the responsibility of its occupants, with the Driver's vehicle and insurance, whose validity (licence, insurance) is a condition of using the service. Stopingo does not guarantee that a Driver will be available at any given moment: the Platform arranges meetings between routes that already exist.
Article 7 : Cost sharing
The amount asked of the Passenger is a Cost share (fuel, tolls, wear) split pro rata among occupants and capped automatically under the legal rule. Deriving a profit from using the Platform is strictly prohibited: as the car fills up, each share decreases, up to covering at most the Driver's costs in full. Within that limit, the sums received by the Driver are cost sharing between private individuals, not income. The Cost share is fixed when the Passenger gets in and paid out with no commission, by bundled monthly transfer.
Article 8 : The boarding code
Each boarding is confirmed by the Boarding code, displayed by the Driver and typed in by the Passenger, in person. That code stands as proof of the meeting: it triggers the Journey, the payment and the tracking. Nothing is charged before. Any circumvention of the Boarding code is a breach of these terms (Article 13).
Article 9 : Cancellations and journeys that do not take place
Nothing is owed until the Boarding code has been entered. The Passenger may withdraw their request at any time before boarding, free of charge; a request left unanswered expires on its own. The Driver remains free not to stop, with no penalty: the Passenger's request then stays live and the search resumes. A Journey that did not take place is not charged, Service price included; where a relay Journey is interrupted, only the Legs actually made are due.
Article 10 : Payment, and the mandate given to the platform
Payments are executed by an authorised payment services provider. Funds are held by that provider in segregated accounts: they never pass through an account opened in Stopingo's name. By publishing a trip, the Driver mandates Stopingo to pass payment instructions to that provider on their behalf; the split is computed under the rules described in these terms. The Service price is charged to the Passenger and is never deducted from the Cost share due to the Driver.
Article 11 : Member content and moderation
What you publish (profile photo, reviews, profile information) remains your responsibility and must be accurate and lawful. After review, Stopingo may refuse to publish or remove content that is manifestly unlawful or contrary to these terms, issue a warning, or apply the measures in Article 13. Reviews reflect journeys actually shared: they can be neither bought nor traded.
Article 12 : Members' obligations
Everyone undertakes to respect the law, other Members and road safety rules. The Driver only interacts with the app when stopped or by voice. Prohibited in particular: any fraudulent use, any diversion of the cost-sharing logic (notably carrying on a disguised professional transport activity), and any circumvention of the Boarding code.
Article 13 : Reports, restriction and suspension
Every Journey can be reported from the app; every report is read by someone on our team. Where these terms are breached, Stopingo applies graduated measures: warning, restriction of features, suspension pending review, or permanent suspension for a serious or repeated breach. Explaining it to you, except where the law forbids it.
Article 14 : Termination, mediation and applicable law
You may close your account at any time, from the app's settings. In the event of a dispute, an amicable solution is sought first; you may use consumer mediation free of charge on the terms set out in the legal notice. These terms are governed by French law; failing an amicable resolution, any dispute falls to the competent courts.
